Terms and conditions
GENERAL
1.1 NV EXPLOITATION CASINO MIDDELKERKE, with registered office at 8430 Middelkerke, Leopoldlaan 115, registered with the Crossroads Bank for Enterprises under number BE 0782.601.344 (hereinafter "Casino Middelkerke"), Casino Middelkerke offers you the opportunity to participate in paying casino games for which Casino Middelkerke operates under the jurisdiction of the Belgian Gaming Commission. As a result, Casino Middelkerke is subject, inter alia, to the Law on gambling, betting, gaming establishments and the protection of players of 7 May 1999, as well as the legal provisions on money laundering, which Casino Middelkerke intends and will always comply with with the utmost care.
1.2 These general terms and conditions (the "General Terms and Conditions") are intended to clarify the terms and conditions under which you may be granted access to the gaming room of Casino Middelkerke (the "Games Room") and, where applicable, participate in the casino games offered by Casino Middelkerke in the Games Room (the "Game(s)"). The General Terms and Conditions shall apply whenever you wish to enter the Games Room, irrespective of whether you wish to participate in the Games.
1.3 The most recent version of the General Terms and Conditions are available for inspection at the registration desk. You can also request a written copy of the most recent version of the General Conditions here at any time.
1.4 If you register, you expressly acknowledge that you have read and understood the General Terms and Conditions prior to registration. Signing the admission form also implies that you have accepted the General Terms and Conditions. Without acceptance of the General Conditions, you cannot be granted access to the Games Hall or be issued with a membership card. If at any time you do not agree or no longer agree with one or more provisions of the General Conditions, you may not enter the Games Hall.
REGISTRATION
2.1 Before gaining access to the Games Hall, you must register as a customer, regardless of whether you wish to participate in a Game or not. This can be done at the registration desk, or via pre-registration on our website (if available). Upon registration, you will be asked to provide valid proof of your identity (e.g. ID card, passport, or via Itsme where available). Casino Middelkerke is required by law to keep a copy of your ID, or otherwise validly retain your identity details. You will be asked to complete an application for admission by providing, inter alia, your surname, first name, address, e-mail address (optional), mobile phone number (optional), date and place of birth, nationality number, profession and your signature. If possible, this is done electronically, e.g. by reading your ID card. Where this is not possible (e.g. for information that cannot be read from the ID card or information relating to foreign players who do not have an ID card), the (remaining) information in the admission application must be entered manually. Finally, a photograph will also be taken of you. For further information on how these data are processed by Casino Middelkerke, please refer to the privacy statement on the back of the Membership Application.
2.2 Upon registration Casino Middelkerke will assess whether you meet the admission requirements mentioned in article 3. If this is the case, you will receive a membership card valid for one (1) year. On each subsequent visit to the Playroom you must present your membership card at the entrance to the Playroom. Without your membership card, you cannot, in principle, enter the Playroom. If you do not have your membership card with you, you may only gain access to the Games Hall after providing valid proof of your identity to the satisfaction of Casino Middelkerke (e.g. ID card, passport or driving license).
2.3 Each Player can only have one (1) membership card. Member cards are personal and may not be transferred or used by any other person in any way (e.g. sale, hire, exchange, provision, transfer, etc.), even free of charge. A player can have as many as 2 player cards.
2.3 After the expiry date of the membership card, when you next visit the Games Hall, you will be asked to go through the registration process described above again so that a new membership card can be created.
ADMISSION CONDITIONS
3.1 Casino Middelkerke shall be entitled to refuse you access to the Games Room and/or Casino on a temporary or permanent basis, including during a visit or at any time thereafter, if Casino Middelkerke is of the reasonable opinion that you are in breach of the admission conditions set out below. Assessment of whether the admission conditions have been breached is at the discretion of Casino Middelkerke staff.
3.2 Registration conditions: You must always provide accurate and complete information upon registration. Should you fail to provide us with the requested information, fail to produce a valid identity document, fail to sign the application for admission or should Casino Middelkerke suspect that you have supplied false information, your registration will not be valid and no Membership Card can be granted. In such case Casino Middelkerke will also deny you access to the Games Room (temporarily or permanently).
3.3 EPIS verification: Casino Middelkerke is required by law to verify whether your name appears in the Excluded Person Identification System ("EPIS") of the Gaming Commission. The EPIS system serves to prevent players who are not allowed to participate in gambling (e.g. due to professional reasons, age, gambling addiction, voluntary withdrawal, etc.) from gaining access to the Games Room. If your name appears in the EPIS system, you will be denied entry to the Games Room without question.
The EPIS check may take place by reading your ID card, by reading your membership card or by entering the data otherwise provided by you into the relevant system. If immediate verification is not possible due to circumstances (e.g. because of a breakdown of the Gaming Commission's verification system), you may still be asked to leave the Gaming Hall even afterwards if it appears that you are indeed registered in the EPIS system and you were granted unauthorised access to the Gaming Hall. You shall in such case have no right to file a complaint against Casino Middelkerke for granting you (temporary) access to the Games Hall.
3.4 Safety of staff and clients: In order to ensure the safety of Casino Middelkerke's clients and staff at all times, you may be denied access to the Games Room in the following cases, among others:
Signs of intoxication;
Cheating and/or dishonest play, fraud or other illegal practices;
Aggression towards staff and/or other customers;
Coarse language of vulgar, obscene, threatening, homophobic, insulting, sexual, racist, discriminatory or other unbecoming nature;
Causing damage (material or reputational);
Disturbing other players of the casino, for example but not limited to players begging for money, interfering with the normal course of play, disturbing concentration, etc.;
Conduct which, in the casino's opinion, is contrary to public order or morality;
Suspecting the commission of a crime, including but not limited to money laundering, using a stolen bank card or stolen funds, or otherwise using assets that do not lawfully belong to the player;
Security incidents or problems that have occurred at Casino Middelkerke and/or other European casinos involving you or anyone who may be directly or indirectly linked to you;
Violating any of the provisions of these General Terms and Conditions
Any other conduct that is contrary to the economic, financial, moral, reputational or other interests of Casino Middelkerke.
If you meet 2 or more of the criteria below, you may also be denied access to the Games Room after consultation with a person with higher authority within Casino Middelkerke (e.g. a table manager or slot manager):
Coming from a geographical area where there are indications that persons from the same background could pose a real risk (temporarily or otherwise) to Casino Middelkerke;
In case of doubt about your identity, being unable to present additional documents proving permanent residence and/or domicile in Belgium;
Offering yourself for registration in a group of more than 2 persons;
Offering yourself for registration after a previous visit during which no use was made of the services offered in the casino.
3.5 Problems on previous visits: If any problems were noted on previous visits and/or you were denied access to the Casino's Playroom on previous visits (e.g. in case of intoxication), you may be denied access to the Playroom on a new visit - temporarily or permanently.
3.6 Clothing and personal items regulations: Casino Middelkerke may refuse you entry to the Games Hall if you do not comply with the dress code. Not permitted are, inter alia, tracksuits, workwear, swimwear, sleeveless t-shirts, soiled clothing and/or flip-flops.
At the request of any member of Casino Middelkerke staff, the following items of clothing and/or personal items must be left in the cloakroom: long coats, thick winter coats, hooded jackets, shopping bags, rucksacks, suitcases and/or trolleys. Small handbags and/or fanny bags may possibly be allowed in the Playroom, possibly after prior inspection of their contents. Refusal to leave any of the foregoing garments or items in the cloakroom may result in a refusal to enter the Games Hall.
3.7 Refusal to submit to metal detection: Staff members of Casino Middelkerke may request you to undergo voluntary metal detection. Should you refuse to submit to such metal detection or should a positive metal detection have occurred, you may be denied access to the Games Room.
3.8 In the event that any of the above-mentioned admission conditions are breached in the opinion of Casino Middelkerke, the casino shall be entitled to suspend its commitments, including but not limited to suspending the commitment to exchange into cash or book money the player funds in your possession at the time of denial of your admission to the Games Hall (i.e. the balances in your virtual player account, the chips and/or tokens in your possession from the casino and the printed tickets entitling you to a payout from the casino). The right of suspension applies until you have (again) fulfilled all your obligations to the casino, or to any third party. In case of dispute, you are always free to exercise your legal rights.
PARTICIPATION IN THE GAMES
4.1 After registration, you will be offered the opportunity to gain access to the Games Room and, if desired, participate in the Games. In doing so, you must always act in accordance with these General Terms and Conditions, applicable laws, and any other contractual or other obligations that may be incumbent upon you. You bear full responsibility for this.
4.2 A Game may only be participated in accordance with the Game Rules applicable to the Game. Participation in the Game in any other manner will not be tolerated and may result in permanent exclusion from the playing room.
4.3 The game rules applicable to and the winnings that can be realised with a Game are indicated or explained on the relevant Game or can be consulted in the Casino upon simple request. If you wish, you can always request explanations about your chances of winning from the Game Room staff. The actual calculation of winnings in accordance with the rules applicable to the Game shall always take precedence over any other communication or title issued to the Player, including but not limited to amounts incorrectly stated on tickets printed by the Game, stating incorrect amounts of winnings on the Game screen, printing tickets that entitle the Player to winnings or reporting on the Game screen that the Player has won when under the rules applicable to the Game, the Player has not made a win, etc. You are expressly advised that winnings on automatic Games can never exceed one hundred thousand (EUR 100,000). Any communication, communication, documentation or any other information to the contrary is invalid and based on a technical error.
4.4 It is strictly forbidden to manipulate or attempt to manipulate by any technical (e.g. use of mobile phones, cameras, any software, any signalling devices, etc.) or human (e.g. collusion between several players) process the organisation and/or the conduct of the Games with the aim of modifying the results or any element that may determine the outcome of a game. In case of any form of cheating or dishonest playing, fraud or any other illegal practice, Casino Middelkerke, at its discretion, is entitled to temporarily or permanently deny you access to the Games Hall and/or Casino. Casino Middelkerke also has the right to disclose your details in such a case to other casinos or gaming halls or to the Belgian Gaming Commission or any other authority

WARRANTIES RELATING TO THE GAMES
5.1 You understand and accept that the Games may be unavailable and/or access to them may be interrupted or suspended, including but not limited to cases of:
Performing maintenance works;
Updating hardware or software;
Performing repairs of all kinds;
Unavailability or understaffing of personnel;
Technical, electronic, or other failures that would compromise the smooth running and/or proper operation of one or more Games;
Defects in hardware or software;
Routing problems;
The consequences of a virus, malware, programming error, irregularity or technical defect;
Any technical, hardware or software related defect of any nature that disrupts or limits participation in any of the Games.
5.2 Casino Middelkerke procures the Games from third parties and is not responsible for any errors that may occur in the Games. This means that you understand and accept that the Casino cannot guarantee that the Games are error free. It is always possible that the Games may contain technical faults, software errors, bugs, viruses, malware, and other errors.
5.3 It follows from the foregoing that Casino Middelkerke makes no warranty as to the availability and/or content of the Games. Casino Middelkerke will endeavour to ensure that any unavailability and/or errors in the Games are rectified as soon as possible, but is in no way liable for any damages that may arise therefrom. The Casino performs its obligations as a normal, diligent and diligent operator in the casino sector and all commitments made in this context by the Casino are to be considered as resource commitments (and not result commitments).

ILLEGAL ORIGIN OF FUNDS
6.1 You represent and warrant to Casino Middelkerke (and shall fully indemnify Casino Middelkerke for any and all damages arising therefrom) that the funds you use to participate in the Games do not originate from any illegal activities. You also undertake not to use the Games to engage in any unauthorised or fraudulent practices or carry out any prohibited transaction (including money laundering, using a stolen bank card or funds, or otherwise using funds that do not lawfully belong to you).
6.2 In the event the Casino determines or suspects that you are guilty of a practice described in clause 6.1 or any similar activity, Casino Middelkerke shall be entitled to:
Immediately deny you any access to the Games Room and/or the Casino, temporarily or permanently;
Suspend its obligations in the manner described in article 3.8 of these General Terms and Conditions;
Transmit this information (including your identity) to the relevant governmental and/or judicial authorities (including but not limited to the Belgian Gaming Commission), banks, providers of debit cards and of electronic means of payment, or any other financial institutions and/or to any person or entity legally entitled to such information or with which the casino has an agreement to transmit such information;
To take any necessary legal action.

INTELLECTUAL RIGHTS
7.1 The intellectual and industrial property rights relating to drawings, models, literary works and/or documents (stored in a durable manner or in machine language), reports, software and databases, as well as the methods, know-how, concepts and other developments of which the casino is the owner or licensee, shall continue to belong to the casino as owner or licensee.
7.2 The casino does not grant any exploitation right to the Player to use, reproduce, distribute or make use of the casino materials in any way other than permitted under these terms and conditions.
7.3 It is expressly prohibited to make any image, sound or other recordings of the gaming room, the casino materials, players, casino staff or any other without prior written consent from the casino.
PROCESSING OF PERSONAL DATA
8.1 In performing its services to you, Casino Middelkerke collects and processes certain data from you that may be considered personal data. Casino Middelkerke does so in its capacity as data controller.
8.2 In processing your personal data, Casino Middelkerke shall always act in accordance with the legal provisions applicable to the protection of your personal data, including but not limited to the provisions of the General Data Protection Regulation.
8.3 For more information on how Casino Middelkerke processes your personal data, please refer to the privacy statement which can be found on the back of the admission application. You can also always request a written copy of the most recent version of this privacy statement at the registration desk.
LIABILITY
9.1 To the maximum extent permitted under applicable law, the total cumulative liability of Casino Middelkerke in relation to its services to you, including but not limited to any contractual and/or extra-contractual liability or otherwise, shall be limited to an amount of EUR 100,000.
9.2 Under no circumstances shall Casino Middelkerke be held liable for any indirect or unforeseeable damage or loss, including, but not limited to, loss of opportunity, loss of profits, loss of time, loss of clientele, loss of revenue, loss of data, increase in overheads, third party claims, reputational damage and/or personnel costs.
9.3 Without prejudice to the provisions contained in the playing rules applicable to the Game, to the extent permitted by applicable law, Casino Middelkerke shall not be held liable for any errors that occur during the execution of a Game, including but not limited to an error during the dealing of playing cards or cheating by a dealer employed by the casino. You understand and accept that errors in the conduct of the Game may occur at any time and are considered a minor error only. Furthermore, Casino Middelkerke is not responsible for any third party products and/or services allegedly offered in the casino.
9.4 Casino Middelkerke shall not be liable for any loss or damage suffered by you as a direct or indirect result of the fact that its services are prevented, hindered or delayed due to circumstances or events beyond Casino Middelkerke's control or over which Casino Middelkerke has no reasonable control, such as but not limited to strikes, lock-outs, labour disputes, breakdown of installations or machinery, problems on the part of suppliers, etc.
9.5 In order to reasonably allow Casino Middelkerke to gather the necessary electronic evidence in case of disputes, any claim against the casino must be submitted within a period of 30 (thirty) calendar days from the moment the cause of action arose.

CHANGE
Casino Middelkerke reserves the right to unilaterally amend these General Terms and Conditions, including the admission conditions, without prior notice. As the case may be, the amendments will be immediately applicable after distribution of the new provisions, which will be freely available for consultation at the entrance of the Games Room.

PROOF
Middelkerke Casino may, in the event of a dispute, provide proof via the computer systems and files at its disposal. The Casino uses industry-compliant informatics systems that are kept under reasonable secure and reliable conditions, so that these may be considered, subject to proof to the contrary, as evidence of transactions made by the Player on the machines. Consequently, it is agreed that, except in the case of manifest error, the casino may rely on the programmes, data,files and other elements (such as follow-up reports or others) prepared, received or kept indirectly or directly by it and in particular in its informatics systems in action, any fact or any omission, and that these elements will also be admissible in any dispute proceedings, subject to proof to the contrary.

RESPONSIBLE GAMBLING
12.1 Participation in the Games is always at your own risk. Nevertheless, Casino Middelkerke advises you to play in moderation. You are advised that extending the duration of play or increasing the frequency of play may be addictive for some persons or lead to a certain psychological fragility.
12.2 You should know that addiction arises from inappropriate, persistent and repeated use of the game. The enjoyment of the game turns into an imperative need to play and this can have serious consequences, both for the user and those around him.
12.3 You may at any time seek the advice of Casino Middelkerke, which fights against pathological and excessive gaming, in order to prevent all risks of dependency. You can also register in the EPIS system of the Gaming Commission, agree on a voluntary exclusion with the casino and/or seek help from organisations specialised in the fight against addiction. Leaflets from the Gambling Commission containing all necessary explanations on measures you can take in case of gambling addiction can be found at our registration desk.
12.4 You will be informed that, once the registration has been processed in the EPIS system of the Gambling Commission, you will be denied entry to the Games Room and, if applicable, your remaining balance will be refunded. Should it be discovered that, despite being listed in the EPIS system, you have allowed yourself access to the Games Hall in any way, Casino Middelkerke will immediately deny you access to the Games Hall and suspend its commitments in the manner described in article 3.8. In addition, the Casino may contact the competent authorities in this case.

NON-VALIDITY OF CLAUSES
Should one or more provisions of these General Terms and Conditions be found to be invalid or unenforceable for any reason, the provision(s) in question must be amended to the extent possible in the sense that they would be valid or enforceable. Should one or more provisions of these General Terms and Conditions be declared invalid or unenforceable, this shall in no way affect the force and scope of the remaining provisions of these General Terms and Conditions.

APPLICABLE LAW AND COMPETENT COURTS
15.1 These General Terms and Conditions shall be governed exclusively by and construed in accordance with Belgian law.
15.2 Any dispute concerning the validity, interpretation and/or execution of these General Terms and Conditions shall be finally settled by the competent courts of Bruges.

LANGUAGE
16.1 These General Terms and Conditions are available in Dutch, French, German and English.
16.2 Despite the care taken in translating them, the Dutch version shall prevail in any discussion or dispute regarding the interpretation and/or content of certain provisions of these General Terms and Conditions.​​​
